1. Who We Are

Exilitay Graphics (“we,” “us,” “our”) is the trading name of Sussex Finance Ltd, a private limited company registered in England and Wales with its registered office at 92 Osborne Road, Southsea, Hampshire, PO5 3LU, United Kingdom. We operate the website at https://exilitay.net/ and the Patreon page at patreon.com/cw/Exilitay. We are not VAT registered; prices on exilitay.net are shown as final checkout amounts unless stated otherwise at purchase.

By accessing or using our website, or by purchasing any product or membership, you agree to be bound by these Terms & Conditions. These terms constitute a legally binding agreement between you and Sussex Finance Ltd (trading as Exilitay Graphics). If you do not agree to these terms, please do not use our services or purchase our products.

Nothing in these Terms limits any mandatory statutory rights you hold under the laws of your country of residence that cannot lawfully be excluded or restricted by contract. If you are a consumer in the United Kingdom or European Union, your statutory rights remain fully intact regardless of any other clause in this document.

2. Copyright and International Intellectual Property Rights

All original digital products and content published by Exilitay Graphics — including software, scripts, shaders, visual assets, presets, applications, graphics packs, documentation, and any other proprietary materials made available through our website, memberships, or downloads — are the sole intellectual property of Exilitay Graphics, except where third-party or open-source components are expressly identified.

These works are protected by UK Copyright Law and International Copyright Treaties, including the Berne Convention, which provides protection in over 170 countries.

2.1 Scope of Protection

This protection extends to all original digital assets and software scripts authored by Exilitay Graphics. While user-configurable settings and values themselves may not be subject to copyright, the specific scripts, code structures, and artistic assets used to implement them are strictly protected.

2.2 Licensing

When you purchase a product or subscription, you receive a limited, non-exclusive, non-transferable licence for personal, non-commercial use only. Digital products are licensed, not sold. Your right to re-download content from our website lasts only while your relevant subscription (or one-time purchase entitlement) remains active and in good standing, subject to Section 3.6.

2.3 Prohibitions

You are strictly forbidden from:

• Reselling, sharing, or redistributing any paid content, assets, or account access to any third party;
• Uploading, posting, or transmitting paid content to any platform, file-sharing service, or community;
• Allowing any other person to access your account or use your downloads.

2.4 Personal Modification — Permitted and Prohibited Uses

Many Exilitay scripts and apps are encrypted or obfuscated. You may change the settings and values we expose for personal use. You may not attack, decrypt, or reverse-engineer the protected script itself.

Configs mean settings files and parameter values for ppfilters, mods, and apps (for example, ppfilter adjustment sliders, cam suite app adjustments or other in-product settings). Configs are not the product files themselves (the ppfilter, mod, app, script, shader, or pack).

Permitted:

• Editing configuration values, parameters, and user-facing settings in ppfilters, mods, apps, and related config files for your own use;
• Sharing, uploading, or publishing your configs only — free or paid — on Discord, on exilitay.net (including any member config-sharing features we offer), or on other sites, provided you do not redistribute the underlying Exilitay product files.

Not permitted:

• Decrypting, deobfuscating, decompiling, reverse-engineering, or otherwise attempting to recover the underlying source of encrypted or obfuscated Exilitay scripts, shaders, or apps — this is prohibited and may be unlawful under applicable copyright and anti-circumvention laws;
• Distributing, uploading, sharing, or publishing Exilitay product files themselves (ppfilters, mods, apps, scripts, shaders, packs, or any modified or derivative version of those files), whether free or paid, and whether presented as your own work or otherwise;
• Using Exilitay product files as a base for content sold or given away in any other pack, mod, or product.

2.5 Derivative Works

Distributing any edited or derivative work based on Exilitay Graphics product files — in any form, through any channel, whether free or paid — is a violation of copyright and these Terms. Sharing configs as described in Section 2.4 is allowed and is not treated as a prohibited derivative work under this section.

2.6 Third-Party and Open-Source Components

Certain Exilitay products may incorporate third-party or open-source code (including MIT-licensed research samples) alongside original Exilitay-authored work. Such components remain subject to their respective licences. Your licence to Exilitay paid products does not grant you rights to extract, relicense, or redistribute third-party components separately from those products.

2.7 Enforcement

Paid assets are identified with copyright notices attributing ownership to Exilitay Graphics (including year-specific notices such as © 2025 or © 2026 Exilitay Graphics, as applicable). Unauthorised distribution of paid content (“leaking”) will result in immediate account termination and may lead to legal action for copyright infringement. Refund eligibility in such cases is governed by Section 3.4.

3. Purchases, Subscriptions, and Refund Policy

3.1 Digital Content and Immediate Access

Our products are digital in nature. When you complete a purchase or begin a subscription, you receive immediate access to digital content. By completing your purchase, you acknowledge that:

• (a) delivery and performance of the digital content begins immediately upon payment;
• (b) you are requesting immediate access to the digital content; and
• (c) where permitted by applicable law, you consent to waive any applicable cooling-off or cancellation period (including the 14-day right of withdrawal under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the EU Consumer Rights Directive) in exchange for that immediate access.

This waiver applies only to the extent permitted by the law of your country of residence. It does not affect any rights you retain under mandatory consumer protection laws that cannot be excluded by contract, including your rights under the UK Consumer Rights Act 2015 if digital content is faulty, not compatible, or not as described (reasonable proof of the issue may be required). For the avoidance of doubt, occasional bugs, visual glitches, or conflicts may occur — whether from Exilitay mods, other creators' mods, game or plugin updates, or your own setup — and incorrect installation or configuration can cause further issues. We provide tutorials and install guides with our mods and on our download posts; following those instructions is your responsibility. Issues caused by incorrect installation, unsupported setups, or third-party conflicts are not treated as content being “faulty” or “not as described” solely on that basis (see also Section 7).

3.2 No Refund Policy

Because digital content is delivered immediately upon purchase, all sales are final once you have accessed or downloaded paid content. We do not issue refunds for:

• Change of mind after purchase;
• Failure to cancel a subscription before its renewal date;
• Unused portions of a subscription period;
• Incompatibility with your hardware or software configuration (see Section 7);
• Circumstances arising from a violation of these Terms (see Section 3.4).

UK and EU consumers — 14-day cooling-off: If you are in the United Kingdom or European Union and contact us within 14 days of your initial subscription purchase, we will consider a refund where our records show you have not downloaded or accessed paid community content. If approved, we will refund the payment and cancel your subscription immediately. If our records show you have downloaded or accessed paid content, change-of-mind refunds will not be offered except where required by applicable law.

If you believe digital content you have purchased is faulty, not compatible, or materially not as described, please contact us at contact@exilitay.com. Reasonable proof of the issue may be required (for example screenshots, logs, your CSP/Pure versions, and confirmation that you followed the published install guide). We will assess the claim and, where your statutory rights under applicable law apply and cannot be excluded, we will provide an appropriate remedy. This paragraph does not constitute a general refund guarantee beyond statutory requirements, and does not cover problems caused solely by incorrect installation, unsupported configurations, or conflicts with other creators' mods. Nothing in this section affects your right to raise a dispute with your payment provider where applicable law allows.

3.3 Subscription Billing

Paid memberships on exilitay.net are 30-day subscriptions. Unless you cancel before renewal, your membership renews automatically every 30 days and you are charged again for the next 30-day period.

Payment methods: Subscriptions on exilitay.net are billed safely and securely through Stripe. At checkout, Stripe may present card payment and, on supported devices and browsers, digital wallets such as Apple Pay or Google Pay. Availability of wallet options depends on your device, browser, region, and Stripe's configuration. Use of Apple Pay or Google Pay is also subject to Apple's or Google's own terms and privacy policies. We do not store your full card number, CVV/CVC, or wallet credentials on our servers; sensitive payment credentials are handled by Stripe (and, where applicable, Apple or Google).

Invoices: After a successful payment (including a £0 promotional first period where a promo code applies), we may generate a downloadable invoice in My Account and may attach or email that invoice to you. Invoice “Provided to” details may include your first name, last name (if entered), email address, postcode, and country. Those details are available to you and to Exilitay Graphics for billing, support, and legal/tax records. Further detail is in our Privacy Notice.

• Initial charge: Your first payment is taken at purchase (or recorded as £0 where a valid promo code makes the first period free) and grants access for one 30-day billing period starting on that date.
• Renewal: Subscriptions renew automatically at the end of each 30-day period. Your renewal charge is taken on (or as close as practicable to) the same day each cycle as your original purchase / last renewal. If you do not cancel before that date, you authorise us to charge the then-current price for your tier for another 30 days.
• Cancellation: You may cancel at any time before your next renewal with no cancellation fee and no notice period. Cancel from the Subscriptions tab in My Account. If you subscribed via Patreon, cancel in Patreon instead. Cancellation takes effect at the end of your current paid 30-day period; you keep access until that date, and you will not be charged again unless you resubscribe.
• Forgotten renewals: We do not offer refunds for renewal charges where you failed to cancel before the billing date. Managing your subscription is your responsibility.
• Patreon subscriptions: If you subscribe via Patreon, billing and cancellation are managed through Patreon under Patreon's terms. Our IP, conduct, and content-use rules still apply to Patreon members who receive Exilitay benefits, except where Patreon controls billing.

3.3.1 Upgrades

You may upgrade to a higher tier (for example Standard → Exclusive, or Exclusive → Ultimate) at any time from My Account.

• Access: The higher tier starts immediately after a successful upgrade payment.
• Prorated charge today: You are charged a one-off prorated amount for the remainder of your current 30-day period. We credit the unused portion of what you already paid for your current tier against the price of the new tier. In plain terms: upgrade charge = new tier price − (current tier price × fraction of the billing period still remaining). The amount due is shown in My Account before you confirm.
• Example: Using rounded figures based on our current tiers (Standard about £5, Exclusive about £8, Ultimate about £12 per 30 days — actual live prices are £4.99 / £7.99 / £11.99 and may change): if you are on Standard and upgrade to Ultimate with 15 days left (half the period remaining), the credit for unused time is about £2.50, and the prorated upgrade charge today is about £9.50. Exact figures depend on remaining time and the live tier prices shown in My Account before you confirm.
• Next renewals: After the upgrade, your membership continues on the new tier. At the next renewal date for that billing period you are charged the full recurring price of the new tier for each following 30-day period, unless you cancel or change plan again.
• No refund of the old period: The unused value of your previous tier is applied as a credit toward the upgrade charge only. It is not paid out as cash and is not refundable separately, except where mandatory law requires otherwise.

3.3.2 Downgrades

You may downgrade to a lower tier at any time from My Account.

• No charge today: Downgrades do not create an immediate charge or a cash refund for the unused part of your higher tier.
• Keep current access until period end: You keep your current (higher) tier benefits until the end of the 30-day period you already paid for. The lower tier then starts automatically for the next period.
• Next billing: From that next renewal onward you are billed at the lower tier's recurring 30-day price, unless you change plan or cancel again.
• Changing your mind: You may upgrade again before the period ends (subject to the upgrade / proration rules above), or cancel entirely so access ends at the period end with no further renewal.

3.3.3 Currency and Regional Pricing

We display and take payment in Pound Sterling (GBP, £), US Dollars (USD, $), and Euros (EUR, €). Our base prices are set in GBP. The USD and EUR prices are set separately for each currency and are not a live, exact conversion of the GBP price, so the three currencies do not add up to the same amount and the USD / EUR figures may sit a little above or below a simple day-to-day conversion.

Why the prices differ: each currency is priced on its own for normal commercial reasons — payment-processing and card-network fees, currency conversion and settlement costs, exchange-rate movement, and the wish to keep clean, stable “round” prices rather than a figure that changes with the market every day. We therefore set a sensible fixed amount per currency instead of re-converting the GBP price in real time.

• Current prices (per 30 days, representative): Standard £4.99 / $6.99 / €5.99; Exclusive £7.99 / $10.99 / €9.99; Ultimate £12.99 / $16.99 / €14.99. Prices may change from time to time, and the price shown to you at checkout is always the one that applies.
• How your currency is chosen: by default we suggest a currency automatically using IP geolocation (an IP-to-country lookup based on your internet connection). This estimates your country at a general level only — it is not precise or GPS-level tracking. Further detail is in our Privacy Notice. Because this is based on the internet connection you use, a VPN, proxy, or similar tool can make you appear to be in another country and cause a different currency to be shown.
• Choosing it yourself: you can change the currency manually using the currency selector on the home page and on the registration / checkout page before you subscribe. Whatever currency is shown at checkout is the currency you will be billed in.
• Currency stays with the subscription: once a subscription starts, its billing currency is fixed for that subscription; to change currency you would normally need to cancel and start a new subscription. Your bank's own conversion and any foreign-transaction fees your card issuer applies are outside our control.

3.4 Termination for Policy Violations

If your account is terminated due to a verified violation of Section 2 (copyright and intellectual property) or Section 6 (account security and conduct), any remaining subscription access and time are forfeited. Refunds will not be issued in such cases. The process for termination is set out in Section 6.3.

3.5 Promotional Codes and Discounts

From time to time we may offer promotional codes, trial discounts, or similar offers. Unless we expressly state otherwise in writing at the time of the offer:

• A promo code applies to the first billing period only (the first 30 days). It does not recur on renewals;
• After the promotional period, your subscription renews at the then-current full price for your selected tier, unless you cancel before renewal;
• Promo codes are non-transferable, may not be combined with other offers unless we say so, and may be withdrawn or modified at any time before use;
• Abuse of promo codes (including creating multiple accounts to reclaim the same offer) may result in cancellation of the discount, suspension of the offer, and/or account action under Section 6.

3.6 Downloads, Local Files, and Lost Access

Paid downloads are provided for you to store and use on your own devices under the licence in Section 2. You are solely responsible for:

• Downloading files while your subscription (or other purchase entitlement) is active;
• Keeping your own copies and backups of those files in your personal storage;
• Safeguarding those files against loss, deletion, hardware failure, or accidental overwrite.

We are not a backup service. If you lose your local copies and your subscription has ended, been cancelled, or otherwise lapsed, you will no longer be able to re-download those files from our website, and that access is permanently lost unless you resubscribe (or otherwise regain a valid entitlement) and the files remain available in our catalogue at that time. We do not guarantee that every historical file, version, or pack will remain available for re-download indefinitely. Losing files after your subscription ends does not create a right to a refund or to free restoration of access.

3.7 Gifted Memberships

From time to time we may grant complimentary (“gifted”) membership access via a claim link or direct grant. Gifted access is free of charge for the stated period and tier, and is subject to these Terms (including IP, conduct, and download rules).

• One gift replaces the previous one: Claiming a gift fully overrides any existing gifted access on your account. The new gift's tier and duration start from the claim date. Remaining time from a previous gift is not added on. If you claim a gift while another gift is still active, that is your choice and responsibility.
• Lower-tier gifts: You cannot claim a gift for a lower tier than your current active access (gifted or paid). Wait until that higher-tier access ends, then claim the lower-tier gift if it is still valid.
• Claiming over a paid subscription: If you have an active paid membership and claim a same-tier or higher-tier gift, you must confirm the override. Confirming cancels your paid subscription immediately (not at the end of the billing period), stops further renewals, and replaces paid access with the gift starting that day for the gifted duration only. Unused paid time is forfeited. No refund is issued for unused paid time when you choose this override, except where mandatory law requires otherwise.
• Converting a gift to a paid subscription: Gifted memberships cannot use prorated “Change Plan” upgrades. If you start a paid subscription while a gift is active, that paid plan replaces the gift: you are charged the full recurring price for the selected tier, billing starts from that purchase, and remaining gifted time is forfeited. No refund or credit is given for unused gift time.
• No cash value: Gifts have no cash value, are non-transferable except via the claim process we provide, and do not create a right to a refund or credit against future purchases.

4. Privacy and Data

By using our website or purchasing a product, you agree to our Privacy Notice, which explains what personal data we collect, why we collect it, how it is used, and your rights regarding that data. Our Privacy Notice is available at: https://exilitay.net/privacy-notice/ and forms part of your agreement with us alongside these Terms.

5. Website Use (All Visitors and Members)

This section applies to everyone who uses our website — including visitors who have not purchased anything, and users who have bought a membership or other products. You may browse publicly available pages without purchasing a membership. Creating an account, signing in, and accessing member areas (including downloads, community features, and My Account) require a paid membership or other purchase entitlement we offer. By using the site in any way, you agree to these Terms. You must not:

• Attempt to gain unauthorised access to paid downloads, member-only areas, or other users' accounts;
• Scrape, overload, or otherwise disrupt our systems;
• Upload malware or any malicious code;
• Use the site for any unlawful purpose.

These rules apply equally to non-purchasing visitors and paying members. We may suspend or terminate access at our discretion for abuse or security reasons.

6. User Conduct, Account Security, and Termination

6.1 Account Responsibilities

You agree to provide accurate information for all purchases. You are responsible for maintaining the confidentiality of your account login credentials. You must not share your account, login details, or download access with any third party.

6.2 Age Requirement

You must be at least 18 years of age to purchase a membership or product from Exilitay Graphics. If you are under 18, you may not purchase without the express consent of a parent or legal guardian, who accepts responsibility for compliance with these Terms on your behalf.

6.3 Account Termination Process

Where we have reasonable grounds to suspect a violation of these Terms (including but not limited to account sharing, redistribution of paid content, or conduct violations), we will follow this process:

• Investigation: We will review available evidence, which may include download logs, distribution reports, or other records.
• Warning (where appropriate): For less serious or first-time suspected violations, we may issue a written warning via the email address on your account before taking further action. We reserve the right to skip this step in cases of clear, serious, or repeated violations, such as confirmed public distribution of paid content.
• Termination: If the violation is confirmed, or if a warning has been issued and the conduct continues, your account will be terminated. You will be notified by email.
• No refund on termination: As set out in Section 3.4, no refund will be issued for any remaining subscription period upon termination for policy violations.
• Appeals: If you believe your account has been terminated in error, you may contact us at contact@exilitay.com within 14 days of the termination notice to request a review. We will assess the appeal and respond within a reasonable timeframe. We are not obligated to reinstate accounts where a violation has been confirmed.

7. Product Disclaimer, Availability, and Third-Party Software

Our digital products and services are provided “as is” and “as available.” While we strive for high quality and compatibility, Exilitay Graphics does not guarantee that products will remain compatible with future updates of third-party software, including Assetto Corsa, Custom Shaders Patch (CSP), Pure, or other plugins. We do not warrant uninterrupted, error-free, or always-available website access, downloads, or community features. Planned or emergency maintenance, hosting issues, or events beyond our reasonable control may temporarily affect the Service.

Graphics stacks involve many variables. Bugs, visual artefacts, crashes, or unexpected behaviour may occur from time to time — including in other creators' mods or ppfilters or Exilitay Graphics mods or ppfilters, or from interactions between them and game / CSP / Pure updates. Installing or configuring content incorrectly (for example wrong folders, missing prerequisites, conflicting presets, or skipping required steps) can also break or degrade the experience. We publish tutorials and install / setup guides with our mods and on our community download posts; you are responsible for reading and following those instructions. Support requests that result from skipped steps or unsupported combinations may be declined or redirected to the relevant guide.

It is your responsibility to ensure your hardware and software meet the requirements listed on the relevant product or download page before purchasing. We do not issue refunds for system incompatibility, software conflicts with third-party mods, incorrect installation, or inability to install assets where our published guides were not followed (see Section 3.2), except where mandatory consumer law requires otherwise.

7.1 No Affiliation with Game Publishers

Exilitay Graphics is an independent creator and brand. Exilitay Graphics is not affiliated with Polyphony Digital, Sony Interactive Entertainment, the Gran Turismo franchise, Kunos Simulazioni, or Assetto Corsa. We are not endorsed by, sponsored by, or officially connected with those companies or any related entities. Assetto Corsa, Gran Turismo, and related names and marks are trademarks of their respective owners and are used on this site only for descriptive or compatibility reference. References to third-party games, research, or techniques describe inspiration or technical lineage only and do not imply official affiliation or endorsement. You are responsible for ensuring your use of our mods complies with the terms of any third-party game or platform.

7.2 Third-Party References (Not Outbound Affiliate Links)

Exilitay Graphics is not partnered with, sponsored by, or paid by any third-party brand for links or mentions on our website. We do not use outbound “affiliate links” that earn us a commission when you buy someone else's products or services. Our website may still name or link to third-party games, tools, or sites for information or compatibility only; those purchases (if any) are between you and that third party, and we make no warranties about their products or services.

Separately, we operate an Exilitay Affiliate Programme for approved promoters of our own products. That programme is governed by Section 8 of these Terms.

9. Discord Community Access and Account Linking

Exilitay Graphics operates a Discord community at discord.gg/exilitay. Joining Discord is entirely optional and is not required to purchase or access paid downloads on exilitay.net.

9.1 Linking Your Discord Account

If you have an active paid membership on exilitay.net, you may link your Discord account from My Account to receive paid-tier roles and member channel access matching your subscription (for example Standard, Exclusive, or Ultimate). Our Discord community also has its own rules, posted within the server. By joining or remaining in the server, you agree to abide by those rules.

9.2 OAuth Connection

Linking uses Discord OAuth through our social-login provider (miniOrange). By clicking Connect Discord, you authorise us to associate your Discord profile with your Exilitay account. You may disconnect at any time from My Account.

9.3 Role Sync

Paid Discord roles are granted, updated, or removed automatically based on your exilitay.net subscription status. Upgrades may apply immediately; downgrades and cancellations may take effect at the end of your current billing period, consistent with your website subscription access.

9.4 No Sharing of Website Access

Linking Discord does not grant another person access to your exilitay.net account, downloads, or billing information. Discord role access is separate from your website login and is subject to the same account-sharing prohibitions as set out in Section 6.1.

9.5 Disconnecting

If you disconnect, we remove paid Discord roles linked to your membership and clear stored Discord link data from your Exilitay account. You may reconnect at any time from My Account.

9.6 Discord Platform Rules

Your use of Discord is governed by Discord's own Terms & Conditions and Privacy Policy. We are not responsible for Discord outages, API limitations, moderation actions taken by Discord, or changes Discord makes to its platform.

9.7 Abuse

Attempting to bypass role restrictions, share paid Discord access, or exploit the linking system may result in removal from the Discord server, termination of your Exilitay account, or both, subject to the process in Section 6.3.

10. Limitation of Liability and Indemnity

To the maximum extent permitted by applicable law, Exilitay Graphics shall not be liable for any indirect, incidental, or consequential damages (including but not limited to software corruption, hardware issues, data loss, lost downloads after subscription expiry, or loss of profits) resulting from the use of, or inability to use, our products or services.

Nothing in this clause excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

To the extent permitted by law, you agree to indemnify and hold harmless Exilitay Graphics and Sussex Finance Ltd, and our officers and agents, from claims, losses, and reasonable costs arising out of your breach of these Terms, your misuse of our products, or your violation of any third-party rights (including game publisher or platform terms).

11. International Customers and Consumer Rights

Exilitay Graphics sells to customers worldwide. These Terms are intended to be read consistently with applicable mandatory consumer protection laws.

If you are based outside the United Kingdom, nothing in these Terms removes or restricts any rights you hold under the mandatory consumer protection laws of your country of residence. In particular:

• EU consumers retain rights under the EU Consumer Rights Directive and applicable national law;
• United States consumers retain rights under applicable federal and state consumer protection laws, including state auto-renewal and privacy laws where applicable;
• Australian consumers retain rights under the Australian Consumer Law;
• Consumers in other jurisdictions retain any rights that cannot be lawfully excluded in their territory.

Where a clause in these Terms would be unenforceable under your local mandatory law, that clause shall be read as modified to the minimum extent necessary to make it enforceable, or severed if it cannot be modified, without affecting the remaining Terms.

12. Dispute Resolution and Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Subject to any mandatory consumer protection laws that apply in your country of residence, any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We reserve the right to modify these Terms & Conditions at any time to reflect changes in the law or our services. Where changes are material, we will provide reasonable notice (for example, by email or a notice on the website) before they take effect. Your continued use of the site or purchase of products after changes are posted constitutes acceptance of the updated Terms.
